Sea Forum For Fishers sebagai Sarana Peningkatan Perlindungan Nelayan Migran di Asia Tenggara
Abstract
Paper ini mencoba membahas terkait isu perlindungan pekerja migran (work in fishing) di kawasan ASEAN terkait dengan karakteristik ASEAN yang inklusif. Salah satu permasalahan dalam pekerja migran di ASEAN adalah isu perlindungan nelayan migran di sektor perikanan laut. Mekanisme perlindungan terhadap nelayan migran di sektor perikanan laut telah diatur dalam beberapa konvensi dan perjanjian internasional, terutama yang telah disediakan International Labour Organization (ILO) melalui The Work in Fishing Convention tahun 2007 (No. 188). Namun demikian masih banyak kendala yang dialami dalam implementasi regulasi tersebut. Salah satu alternatif dalam mengimplementasikan regulasi yang ada dalam kawasan ASEAN adalah adanya SEA Forum for Fishers. Berdasarkan literatur tentang masyarakat transnasional dan hukum internasional, maka paper ini berupaya memberi gambaran dan analisis SEA Forum for Fishers sebagai bentuk kerjasama ASEAN untuk lebih meningkatkan perlindungan terhadap nelayan migran sesuai dengan semangat “ASEAN 2025 Forging Ahead Together”.
